Digital Duty of Care Bill

About the consultation:

The Senate Committee on Environment and Communications Legislation is inquiring into the proposed Online Safety Amendment (Digital Duty of Care) Bill 2026 (DDOC Bill).

The proposed DDOC Bill would replace the existing co-regulatory industry online safety codes with a new digital duty of care framework, applying also ISPs.

Inquiry reporting date: 20 November 2026

You can read the proposed DDOC Bill, and the Inquiry information on the Parliamentary website:

IAA is concerned that the proposed DDOC Bill does not adequately distinguish ISPs as mere conduit providers with little to no control of content shared over the Internet. Our response will focus on making sure all obligations that would apply to ISPs are reflective of the technical and operational realities of ISPs’ role within the online ecosystem.

Please also feel free to provide any input to IAA’s response by contacting policy@internet.asn.au.
